Terms and Conditions
These terms govern every purchase made at aliena.me. Please read them before ordering.
1. Provider
Aliena Strobel
Säntisstraße 8
78464 Konstanz
Germany
Email: aliena@aliena.info
These terms apply to all contracts concluded between us and you as a customer through this website. Any conflicting terms of your own do not apply unless we have agreed to them in writing.
2. What we sell
We sell guided audio files (“Audio Guides”) as digital downloads. They are spoken recordings layered with music, intended for relaxation and personal reflection. Product pages describe length, theme and format. No physical goods are shipped.
3. How a contract is formed
Placing products in the cart is not an offer. By clicking the order button you make a binding offer to purchase. The contract is concluded when we confirm your order by email or make the download available, whichever happens first. The contract text is not stored by us separately; you receive all details by email.
4. Prices and payment
All prices are final prices in euros. Under the small business regulation of § 19 UStG (German VAT Act), no value added tax is charged or shown.
Payment is processed through WooPayments (Automattic Inc.) in partnership with Stripe Payments Europe, Limited. Payment is due immediately on conclusion of the contract. Your card details are entered directly with the payment provider; we never receive your full card number.
5. Delivery
After successful payment you receive a download link by email, or access through your customer account. Delivery is immediate in normal circumstances. If you have not received your link within one hour, please check your spam folder and then contact us.
You are responsible for providing a correct email address and for having a device able to play standard audio files.
6. Right of withdrawal
Consumers have a statutory right of withdrawal. Important: for digital content this right expires as soon as we begin delivery, provided you have expressly consented to this and confirmed that you thereby lose your right of withdrawal. You give this consent by ticking the required box during checkout.
Full details and the model withdrawal form: see our Cancellation & Refunds page.
7. How you may use the Audio Guides
On payment you receive a simple, non-exclusive, non-transferable licence to use the Audio Guides for your own private, personal purposes, without time limit.
You may not: resell, rent, lend or pass them on; upload them to any platform, website or file-sharing service; use them publicly, commercially or in a therapeutic, coaching or classroom setting; edit them, extract parts of them, or remove any markings. All rights not expressly granted remain with us.
8. Warranty
Statutory warranty rights apply. If a file is faulty, incomplete or a link does not work, contact us and we will provide a working file or refund you. This applies regardless of the right of withdrawal.
9. Important note on health
Our Audio Guides are intended for relaxation and personal reflection. They are not medical or psychological treatment and are no substitute for therapy, medical advice or medication. They do not diagnose, treat or cure any condition. If you are dealing with a medical or mental health issue, please speak to a doctor or a qualified professional. Do not listen while driving or operating machinery.
10. Liability
We are liable without limitation for damage resulting from injury to life, body or health, and for damage caused intentionally or through gross negligence. In cases of slight negligence we are liable only for breach of an essential contractual obligation, and then only for foreseeable damage typical of this type of contract. Liability under the German Product Liability Act remains unaffected.
11. Data protection
Information on how we handle your data is set out in our Privacy Policy.
12. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in another country, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
14. Severability
If any provision of these terms is or becomes invalid, the validity of the remaining provisions is not affected.
